Although when compared with other states, Texas gun laws are less restrictive, there are still laws that govern the ownership of firearms in the Lone Star State. Not Everyone Can Own a Gun
There are restrictions in place to keep people who are considered high risk of owning a gun. This includes the inability of anyone for which the following is true to purchase a gun:
- Those who have been convicted of a felony within five years of release or parole.
- Those who are minors and do not have their parents’ permission.
- Individuals who are currently incarcerated in a penal institution.
General Restrictions on Carrying a Gun
In general, no one is allowed to carry a gun on or near school grounds within the state of Texas. However, there are some exceptions to this rule. For example, there are provisions made for certain law enforcement officials and exceptions given to certain individuals who have a valid carry concealed license.
Concealed Carry is Applicable in Texas
If an individual has a concealed carry license, they can carry a revolver or pistol on their person virtually anywhere, except locations that have their own restrictions, such as school grounds. Shotguns or rifles do not have to be concealed and do not require a special concealed license, but they must be carried in such a way that they don’t cause alarm in others.
The Motorist Protection Act: Firearms in Vehicles
All Texans can now carry a loaded handgun, within their reach in their own vehicle as long as its concealed. This is made possible thanks to the passage of the Motorist Protection Act. Long guns, like shotguns and rifles, do not have to be concealed. If a motorist with a concealed weapon is pulled over and asked for their ID, it’s their responsibility to inform the officer that they have a concealed weapon in the vehicle.
